Minnesota Insurance Regulations

In Minnesota, a lapsed policy may be reinstated:

  1. within 1 year of policy lapse
  2. up to 90 days after the grace period expires
  3. never
  4. within 3 years of policy lapse

One method of managing risk is to transfer the risk to another party. For many risks, the best way to transfer them is through insurance. Risk transfer, simply put, is to place the burden of possible economic loss on someone else. When insurance is purchased, a large, uncertain loss is exchanged for a small, certain loss, the premium.

When you sell one fund and use the proceeds to buy another fund of the same fund family you may avoid paying a sales charge, but you can't avoid the IRS. If you sell, you recognize a capital gain or loss. The IRS accommodates for portability of funds in life insurance and annuity contracts. Internal Revenue Code 1035, allows the transfer of funds from one product to another or from one company to another. Under 1035 exchange rules, tax on accumulated earnings will be deferred for the following transfers:

  • Insurance Policy into another Life Insurance Policy
  • Life Insurance Policy into an Annuity
  • Annuity into another Annuity
    •

    If a policy lapses, Minnesota insurance law allows the policy owner may apply to have the policy reinstated. The insured must provide evidence of insurability; and pay past-due premiums, any outstanding policy loans, and interest on the outstanding loan and past-due premiums. Reinstatement must be applied for within 3 years.
